  1. ELIGIBILITY:

    Participation constitutes full and unconditional agreement to, and acceptance of, these Official Contest Rules (the “Rules”). Maxiphlex – The Next Top STAR 2016, (“Jean Yip”) is open to all legal residents of Singapore (Singaporeans, Singapore PR Holders, persons holding long term dependant passes and Singapore work permit holders) who are 18 years of age or older. Employees, officers, and directors of Jean Yip Salon Pte Ltd, its subsidiary companies, affiliates, subsidiaries, advertising, promotion and fulfilment agencies, their immediate family members and persons living in their same household, are not eligible to participate in the Contest. This Contest is offered only in Singapore and shall only be construed and evaluated according to Singapore law.

  3. GENERAL RULES OF CONTEST:

    To enter the Contest, you must (a) register online (b) submit three (3) photographs of yourself (see “How To Enter” below) and (c) must have patronised one of Jean Yip Salon Pte Ltd’s Participating Outlets for a Maxiphlex Treatment. The Contest begins on September, 2016 and ends on Jan 31, 2017. The selection criteria for determining the winning entry will depend on popular vote and the decision of a panel of judges appointed by the management of Jean Yip Salon Pte Ltd.

  5. HOW TO ENTER:

    You may enter the Contest by taking the following steps: Online: Go online to www.maxiphlex.com register your entry as follows:
    1. You must be at least 18 years of age.
    2. You must have patronized Jean Yip Salon Pte Ltd and had your hair treated with “Maxiphlex Treatment”
    3. Snap three (3) photographs of yourself against a white background or designated photobooth at Jean Yip Hairdressing outlets.
    4. From crown of head to chest line (Pic 1 ) – Front Profile
    5. From crown of head to elbow (Pic 2) – Side Profile
    6. From crown of head to elbow (Pic 3) – Back Profile
    7. Log in onto www.maxiphlex.com – Click Join Contest
    8. Type in your Name, NRIC, e-mail, mobile number, branch, hairstylist, invoice number, upload the 3 photos and click “Submit”
    9. Go to your e-mail to receive confirmation of participation and click “Confirm”
    10. Successful contestants’ pictures will be uploaded onto the website www.maxiphlex.com

  7. SELECTION OF WINNER:

    The criteria for determining the winning entry will be determined by popular vote and the decision of the panel of judges. Their decision in the selection of the winner is final. The Winner will be determined within 60 days after the end of the Contest; however, Jean Yip Salon Pte Ltd reserves the right to take more or less time to determine the winner as it deems necessary in its sole discretion.

    The winner will be selected by the Panel, and will be subject to approval by the management of Jean Yip Salon Pte Ltd pending confirmation of the winner’s compliance with these Official Contest Rules. Jean Yip Salon Pte Ltd’s decisions are final on all matters relating to this Contest. The winner will be notified by phone, or email.

  9. SPECIAL TERMS:

    Jean Yip Salon Pte Ltd reserves the right, in its sole discretion, to reject any photographs. No inappropriate, indecent or obscene photographs may be submitted to Jean Yip Salon Pte Ltd for entry into the Contest or submitted for display on the Jean Yip Website. Visitors to the Jean Yip Website may notify Jean Yip Salon Pte Ltd through the “Contact Us” button of any photographs or captions that appear to violate these Rules. Jean Yip Salon Pte Ltd will use its best efforts to exclude any such photographs or captions; however, Jean Yip Salon Pte Ltd is not a publisher of the photographs; it is merely providing a forum for the display of these photographs for voting purposes and, therefore, Jean Yip Salon Pte Ltd expressly disclaims any and all liability associated with the display of any of the photographs on the Jean Yip website.

  11. REPRESENTATIONS AND WARRANTIES OF ENTRANT:

    Entrant represents and warrants to Jean Yip Salon Pte Ltd, its affiliates and its advertising sponsors that: (a) he/she is over 18 years of age and a legal resident of Singapore; (b) he/she has all of the rights and authority necessary to submit the photograph for entry in the Contest in compliance with the Rules, including the right to publish the photograph, and the right to grant the Promotion Release set forth below; (c) the publication of the photograph will not infringe on the rights of any third party; (d) the photograph submitted has not been digitally, or otherwise, altered.

  13. PROMOTION RELEASE:

    By submitting an entry and participating in the Contest, the entrant, irrevocably transfers, grants and assigns to Jean Yip Salon Pte Ltd, its affiliates and its respective successors, assigns, and licensees, the right worldwide and in perpetuity, to use the name, likeness, image and photographs, including any reproductions of same, in any and all media including radio, TV, Newspapers, Magazines and all other media both local and international without limitation, use on the Jean Yip Website in connection with the Contest or other promotions, for any advertising or promotional purposes without additional compensation, and releases Jean Yip Salon Pte Ltd and any entity acting on behalf of Jean Yip Salon Pte Ltd. from any liability with respect thereto.

  15. RELEASE OF LIABILITY:

    Entrant, for herself/himself, agrees that Jean Yip Salon Pte Ltd, its affiliates and its employees, officers, directors, shareholders, agents, representatives, its respective successors, assigns, agencies and licensees shall not be liable for any personal injury, death, loss or damage of any kind or any other causes of action or claims related to entrant’s participation in this Contest or acceptance or use of the prize awarded including, without limitation, any claims based on publicity rights, defamation or invasion of privacy. If, for any reason, the Contest or any portion thereof is not capable of running as planned by reason of infection by virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Jean Yip Salon Pte Ltd, may corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Jean Yip Salon Pte Ltd reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest or any part of the Contest, and select the winner for the Contest from the entries received prior to the action taken or in other such manner as deemed fair and appropriate by Jean Yip Salon Pte Ltd.

  17. GOVERNING LAW:

    These rules shall be interpreted and enforced in accordance with the laws of the Republic of Singapore, without regard to conflicts of law principles. Any and all actions, proceedings and disputes between the parties, irrespective of place of execution or performance, shall be instituted and resolved in the courts of the Republic of Singapore.

  19. DISQUALIFICATION:

    Jean Yip Salon Pte Ltd, its legal representatives, affiliates, subsidiaries, parents, agencies and its officers, directors, employees and agents, are not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions or technical failure, lost online entries, lost mail-in entries, jumbled, scrambled or misdirected transmissions, or other error of any kind, whether human, mechanical or electronic. Persons found tampering with or abusing any aspect of the Contest, as solely determined by Jean Yip Salon Pte Ltd, will be disqualified. If disqualified for any of the above reasons, Jean Yip Salon Pte Ltd reserves the right to terminate entrant’s eligibility to participate in the Contest.

  21. GOVERNING LAW:

    These rules shall be interpreted and enforced in accordance with the laws of the Republic of Singapore, without regard to conflicts of law principles. Any and all actions, proceedings and disputes between the parties, irrespective of place of execution or performance, shall be instituted and resolved in the courts of the Republic of Singapore.

  23. INDEMNIFICATION:

    You agree to release, indemnify and hold Jean Yip salon Pte Ltd, its parents, subsidiaries and affiliates, and each of their respective members, officers, directors, employees, agents, co-branders and/or other partners, harmless from and against any and all claims, expenses (including reasonable attorneys’ fees, costs and settlement costs), damages, suits, costs, demands and/or judgments whatsoever, made by any third party due to or arising out of: (a) your participation in the Contest and/or your use of the Website; (b) your breach of these Rules; and/or (c) your violation of any rights of another individual and/or entity. The provisions of this paragraph are for the benefit of Jean Yip Salon Pte Ltd, its parent, subsidiaries and/or affiliates, and each of their respective officers, directors, employees, agents, shareholders, licensors, suppliers and/or attorneys. Each of these individuals and entities shall have the right to assert and enforce these provisions directly against you on its own behalf

  25. LEGAL WARNING:

    Any attempt by any individual, whether or not an entrant, to damage, destroy, tamper with or vandalize the Contest and/or the Jean Yip Salon Pte Ltd Website, or otherwise interfere with the operation of the Contest, is a violation of criminal and civil law and Jean Yip Salon Pte Ltd will diligently pursue any and all remedies in this regard against any offending individual or entity to the fullest extent permissible by law and in equity.

  27. AGREEMENT:

    The “CONTESTANT” declares and agrees upon the terms and conditions as follows:
    The “CONTESTANT” upon winning the title of the “Maxiphlex – The Next Top STAR 2016” shall comply with the terms set out in this agreement.
    28. You may enter the Contest by taking the following steps: Online: Go online to www.maxiphlex.com register your entry as follows:
    1. To qualify, all contestants shall make full and honest disclosure of all the contents in the entry form (hereinafter called the “CONTESTANT FORM”)
    2. All contestants shall comply and fulfill the “Photography” sessions designed for them.
    3. All contestants should understand all terms and conditions before agreeing to participate in “Maxiphlex – The Next Top STAR 2016”.
    4. All contestants below the age of 21 years shall be required to obtain their parents/guardian’s consent to enter the contest.
    5. The organizers shall reserve all rights to reject any application that does not satisfy the aforesaid requirements without giving any reasons.
    6. The contestants must comply and agree to the exclusive rights of the organizers –
      1. For photography, filming, reproduction, recording of all or part of her photograph in the contest.
      2. The right to retain edit or telecast any recording or photography of the Contestant.
    7. The organizers shall own the exclusive and sole rights of all the contestants’ photograph(s).
    8. By entering the contest, the contestants irrevocably and unconditionally grants to the organizers all consent and wavers necessary the organizers or any of them to record and use her performances, in any manner whatsoever and in any part of the world as the organizers or any of them shall in their/its sole discretion deem fit. The contestants acknowledges that the organizers or any part of them shall be at liberty to publish and use any recording made by the organizers, including without limitation audio recording, visual recordings and photography, for the promotion and publicity of the contest.
    9. The organizers shall be under no liability whatsoever to the contestants or personal representatives in respect of any loss, damage or injury to life or property sustained by any contestants at any stage of the contest unless such loss, damage and injury is caused in gross negligence by the organizers.
    10. The contestants shall not without prior consent disclose any information whatsoever relating to the Jean Yip Group/Organizers.
    11. The Organizers reserve the right to substitute, add or alter any item on the list of prizes before the finals. All prizes are not transferable or exchangeable for cash or otherwise.
    12. The Organizers do not undertake any responsibility to ensure that prizes will be delivered by the sponsors to any prize winner. No agreement shall arise or be constituted should there be any errors on the contestants form i.e. missing/incorrect details. In the event that the sponsor fails or refuse for whatever reasons, to deliver or transfer the prize to the contestant, she shall not be liable or responsible for losses (of any nature whatsoever).
    13. There shall be no claims against the organizers or any of them, in the event the contest is annulled, cancelled or postponed by circumstances beyond the reasonable control of the organizers or any of them.
    14. The organizers reserve the right to amend or vary any of these Terms and Conditions without prior notice to any contestant.
    15. Non-compliance with or breach of any of the Terms and Conditions shall immediately disqualify the contestants from further participation at any stage of the contest, including the international contest and any cash and prizes won shall be forfeited.
    16. All contestants by participating in the contest agree to be bound by these terms and conditions.
    17. These terms and conditions shall be governed by and construed in the accordance with laws of The Republic of Singapore.
